Waiver & Release of Liability Disclaimer. PERFECT TEN AFTER SCHOOL PROGRAM AND/OR ANY OF ITS OR THEIR AGENTS, EMPLOYEES, INSTRUCTORS, SPONSORS, OR VOLUNTEERS ("Perfect Ten") ARE RESPONSIBLE FOR ANY INJURY (OR LOSS OF PROPERTY) TO ANY PERSON SUFFERED WHILE PARTICIPATING IN ANY PERFECT TEN ACTIVITIES. TRAVELING TO OR FROM ANY PERFECT TEN ACTIVITIES, OR IN ANY OTHER WAY INVOLVED IN PERFECT TEN ACTIVITIES, FOR ANY REASON WHATSOEVER, OTHER THAN NEGLIGENCE OR WILLFUL MISCONDUCT ON THE PART OF PERFECT TEN OR ITS AGENTS, EMPLOYEES, INSTRUCTORS, SPONSORS, VOLUNTEERS AND ALL OTHERS WHO ARE INVOLVED IN THE OPERATION. In consideration of being allowed to participate in any way in the Perfect Ten program, related events and activities, including any transportation provided to any child by any Perfect Ten director, employee, instructor or volunteer in a personal vehicle or otherwise, I hereby release and covenant not-to-sue Perfect Ten, and/or its directors, employees, instructors, volunteers or agents, from any and all present and future claims resulting from property damage, personal injury or wrongful death, arising out of my child's participation in Perfect Ten activities, and activities incidental thereto, whenever, whenever or however the same may occur unless caused by negligence or willful misconduct on the part of Perfect Ten, its directors, employees, instructors, volunteers or agents. I hereby voluntarily waive any and all claims of negligence or willful misconduct on the part of Perfect Ten, its directors, employees, instructors, volunteers, or agents, both present and future, that may be made my me, my child, my family, or my child's estate, heirs or assigns. In addition, I understand that participation in certain Perfect Ten activities involves activities incidental thereto, including but not limited to, travel to and from the site activity, participation at sites that may be remote from available medical assistance, and the possible of reckless conduct of other participants. Further, I am aware that travel to and from certain Perfect Ten activities may be provided to my child in a Perfect Ten director, employee, instructor or volunteer's personal vehicle. I understand that there involves certain risks when traveling in a motor vehicle, including but not limited to death, and that equipment provided by the motor vehicle manufacturer for my child's protection may be inadequate to prevent serious injury. I am voluntarily allowing my child to participate in this program with knowledge of the danger involved and hereby agree to accept any and all inherent risks of property damage, personal injury or death. I further agree to indemnify and hold harmless Perfect Ten and others listed for any and all claims arising out of my child's participation in Perfect Ten activities and others listed for any and all claims arising out of my child's participation in Perfect Ten activities or any activities incidental thereto, wherever, whenever or however the same may occur. I give Perfect Ten or its designee the irrevocable right to take and use my child's name, picture, likeness, photograph, film, videotape, and or verbal statement in all forms and media and in all manners for any advertising, promotional, Internet (website) and/or publicity purposes of Perfect Ten. I waive any rights I or my child may have in connection with any use of the material, including any right to inspect or approve the finished use, including any written copy that me be created in connection with such use. I understand that this waiver is intended to be as broad an inclusive as permitted by the laws of New York and agree that if any portion is held invalid the remainder of the waiver will continue in full legal force and effect. This is to certify that I, as parent/guardian with legal responsibility (TYPE LEGAL NAME OF CHILD BELOW), have read the above Agreement to Participate with Waiver and Release of Liability Disclaimer and agree to the above terms for myself, my child, my heirs, assigns and next of kin. I release and agree to hold harmless the liabilities incident to my minor child's involvement or participation in these outlined activities as provided above, to the fullest extent permitted by the law.
